E-Mail Abuse Policy

Definitions:

  • spam: commercial, unsolicited E-mail
  • spammer: an individual or an organization who sends spam
  • constant/abusive spam: spam from spammers who do not honor REMOVE requests, whose provider does not honor abuse reports (or who are their own provider), and who abuse users with a large number of messages per day.
  • spam relay: a mail (SMTP) server used to send out spam only

We encourage you to use an approach similar to junk mail as we do. If you do not like the spam, you can simply delete it. However, if a user or a group of users is getting constant/abusive spam, per user request it is up to their E-mail provider to implement appropriate blockage measures. Furthermore, there are some cases where such measures are necessary to protect our system integrity. Therefore, we have implemented the measures below.

Please note that our customers or anyone else are prohibited from using our servers for any mail relaying (spam or not) purposes. Furthermore, our customers may not use any other servers for spam in relation to their site on niinet.net. Note that mailing lists, where each user has subscribed by his or her free will, are not considered bulk mailing.

Anti-Spam/Server Abuse Protection Features:

  • no mail relaying allowed by any remote hosts,
  • mail from certain relays which are used SOLELY for CONSTANT/ABUSIVE SPAM are rejected,
  • mail from certain users (user@domain) who are known for CONSTANT/ABUSIVE SPAM is blocked,
  • access from certain spammers (either sending mail to our servers or using them as relays) is blocked at the router level for the appropriate IP class(es) until the spammer’s provider takes appropriate measures.

How to request Anti-Spam protection:

We will block E-mail from constant/abusive spammers. To request this service, please send us the following:

  • the spam message(s) in its full and ugly form, with the COMPLETE HEADERS shown, AND
  • a note on how many times a day and for how many days you have received mail from this spammer, your efforts to stop it, and their results.

We will generally only block the user@domain From: header. Only if it is proven that the responsible relay is used solely for spamming will that be added to the list (not to block mail from legitimate users using it).

If you require more control over your spam blocking, we recommend a Spam Filter program. You may configure it to avoid virtually any/all potential spam, just make sure to fix its default configuration not to block out valid mail.

If you believe you have seen spam sent through our servers, please let us know at abuse@niinet.net, in order for us to take appropriate preventative measures.

Attacks

Accounts used to carry out attacks (mailbombs, network transport attacks, newsgroup flooding) will be closed immediately upon authorization by a designated member of the staff of nii communications. If compelling evidence suggests that the security of the account was compromised and that the attack was not carried out by the holder of the account then at the discretion of nii communications, the account may be reinstated with a different username/password.

UBE (Unsolicited Bulk E-mail)

A single, substantiated complaint of email broadcasting will result in the suspension of the account determined to be responsible for the email.

First Offense
    1. The customer will be contacted and the reasons for the UBE policy will be explained.
    2. The customer will be asked to abide by this policy.

At the discretion of nii communications, a customer’s account may be reactivated following the customer contact and the customer's agreement to abide by the UBE policy. In the event that a customer does not agree to abide by the UBE policy, the account will be permanently closed

Subsequent Offenses

The account will be permanently closed
